NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 35A-7-101 et seq., 42 U.S.C. 654(a) et seq., and Pub. L. No. 104-193 mandate a new hire registry be maintained by the Department. This rules explains how parties can comply with those laws.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The new hire registry is mandated by federal and state law and is used to assist in child support and detecting fraud against unemployment benefits. By knowing when individuals have returned to work, the agency can stop benefit payments and protect the trust fund. Therefore, this rule should be continued.
