NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Section 53A-11-303 directing the Department to adopt rules and enforce immunizations standards for entry into public, private, or parochial schools through grade 12, licensed day care center, child care facility, family care home or Head Start program unless exempted for personal, medical, or religious objections.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The rule was last updated and changes enacted in 2007 to address the addition of seventh grade school entry requirements. Since the modifications to the rule have been enacted, the Department has not received comments indicating a need to revise this rule further at this time.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

One of the important reasons for requiring school vaccinations is to ensure that children and adults in school and day care group environments are protected from vaccine preventable diseases. All states have school immunization requirements and they are a highly effective public health measure in ensuring against vaccine preventable diseases. The rule also allows the option for those with a philosophical, religious, or medical reason to obtain an exemption from the requirement. Therefore, this rule should be continued.
