NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is enacted under the authority of Subsection 72-1-201(1)(h) which directs the Department of Transportation to make rules "for the administration of the department, state transportation systems, and programs," which includes the debarment or suspension of contractors from consideration for award of department contracts pursuant to Section 63G-6a-904.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written comments from interested persons received during and since the last five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule should remain in effect to provide reasons and procedures for debarment or suspension of contractors from consideration for award of department contracts pursuant to Section 63G-6a-904. Therefore, this rule should be continued.
