NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
As a part of its ratemaking authority in Section 54-4-1, the Public Service Commission must make determinations regarding the accounting of utility costs such as postretirement benefits.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received since the last review in September 2008.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule continues to be necessary in order for the Commission to determine how postretirement benefits are accounted for by the utility companies. Therefore, this rule should be continued.
