NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 79-4-301 authorizes the Board of Parks and Recreation to be the policy making body of the Division. The rule identifies specific requirements and processes before land may be acquired, sold, or leased. This rule was authorized in order to protect persons, property, and natural resources within state park boundaries utilizing a transparent set of policies and procedures for real property issues.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Division of Parks and Recreation has not received any comments on this rule in the past five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Utah Division of Parks and Recreation will continue this rule which protects persons and properties of the state through a transparent set of policies and procedures for real property issues affecting division land.
