NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is adopted under authority of Sections 26-1-30 and 26-5-3. The Cancer reporting rule is adopted to specify the reporting requirements for cases of cancer to the Utah Cancer Registry. Cancers constitute a leading cause of morbidity and mortality in Utah and therefore pose an important risk to the public health. Through the routine reporting of cancer cases, trends in cancer incidence and mortality can be monitored and prevention and control measures evaluated. Cancer records are managed by the Utah Cancer Registry (Registry) on behalf of the Utah Department of Health. The Utah Department of Health retains ownership and all rights to the records.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Division of Disease Control and Prevention has not received comments opposing the rule, or asking for a revision of the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule needs to continue as cancers continue to constitute a leading cause of morbidity and mortality in Utah and therefore, pose an important risk to public health. Through the routine reporting of cancer cases, trends in cancer incidence, and mortality can be monitored and prevention and control measure evaluated. Cancer records are managed by the Utah Cancer Registry on behalf of the Utah Department of Health. This Cancer reporting rule is adopted to specify the reporting requirements for cases of cancer to the registry.
