NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 31A-2-404(2) authorizes the Title and Escrow Commission to make rules for the administration of the Insurance Code related to title insurance, including rules related to standards of conduct for a title insurer, agency, or producer.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments were received by the department in the past five years regarding this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The rule provides guidance to title agents and agencies regarding those actions that are considered unfair inducements and unfair marketing practices. The rule is meant to maintain fair competition among licensees and to protect insurance consumers against unfair practices used to obtain their business. Therefore, this rule should be continued.
