NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53B-8-105 outlines the New Century Scholarship and the requirements for receiving this scholarship. The law indicates dates and minimum standards for eligibility and this rule fully defines the requirements for a student to receive and remain eligible for tuition assistance under this program.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

Since the last five-year review period, there have been no written comments received by the Office of the Commissioner of Higher Education.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Continuation of this rule is necessary as long as the scholarship is funded by the legislature and/or it remains a valid program as presently constituted.
