NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

An individual has the right to be represented by an attorney when the Board of Pardons and Parole conducts a parole revocation hearing.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule specifies the attorney must be licensed to practice law in the State of Utah and comply with the Utah Judicial Rules of Professional Conduct. In addition the rule requires a waiver if the attorney has a potential conflict of interest created by previously being involved with the client as a judge, administrative hearing officer, public official or public employee. The rule is necessary to prevent conflicts of interest and otherwise ensure that individuals under the Board's jurisdiction have counsel that is licensed and in compliance with judicial rules. Therefore, this rule should be continued.
