NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

The current rule is authorized by Section 41-6a-515, Standards for chemical breath or oral fluids analysis-Evidence. Section 41-6a-515 requires the Commissioner of Public Safety to establish standards for administration and interpretation of chemical analysis of a person's breath or oral fluids, including standards and training.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written comments.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Current certification and training comply with this rule. Therefore, this rule should be continued.
