NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 19-6-104 requires the Board to "meet the requirements of federal law related to solid and hazardous wastes to insure that the solid and hazardous wastes program provided for in this part is qualified to assume primacy from the federal government in control over solid and hazardous waste". Section 19-6-105 allows the Board to make rules governing aspects of hazardous waste management. Section 19-6-106 requires the Board to make rules that are no more stringent than the federal rules.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

Two changes were made in this rule during the period from the last five year review. No comments were received during the comment period.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R315-16 is the rule that governs the handling of hazardous waste and allows certain waste, when recycled, to be excluded from the requirements for transporting and treating of hazardous waste. Therefore, this rule should be continued.
