NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
The Utah Caregiver Support Program is created under authority of the Older Americans Act of 1965, 42 USC Section 3001 and Section 62A-3-104. The purpose of the Utah Caregiver Support Program is to provide support services, including information and assistance, counseling, support groups, respite and other home and community-based services to family caregivers of frail, older individuals.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments were received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The Caregiver Support Program is required as part of the Older Americans Act. Utah is required to maintain a level of funding and commitment to the program under the federal act. This rule is needed to continue with the program and provide the structure needed to coordinate state and local agencies.
