NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
The statute authorizes the State Parks Board to promulgate rules relating to the wearing of personal flotation devices in Subsection 73-18-8: "The board may require by rule for personal flotation devices to be worn:...."
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The Division has not received any written comments in support or opposition of this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Our personal flotation device rules are designed to provide safety to individuals participating in boating activities where there is an increased risk of falling overboard or being injured. In many years of collecting boating accident data, the US Coast Guard finds that personal flotation device (PFD) wear has saved a large number of lives and if more persons were required to wear PFDs even more lives would be saved. Therefore, this rule should be continued.
