NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Statute authorizes the State Parks Board to exempt certain vessels from registration in Subsection 73-18-4(1)(e): "(1) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the board shall promulgate rules...": (e) regulating anchored, beached, moored, or abandoned vessels to minimize health, safety, and environmental concerns."

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no comments received either in opposition or support of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The Division of Utah State Parks and Recreation and the Division of Forestry, Fire and State Lands have identified issues relating to vessels that have been left anchored or beached or abandoned on Utah waters. Therefore, this rule should be continued.
