NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53A-24-103 places the Utah State Office of Rehabilitation (USOR) under the policy direction of the Utah State Board of Education (Board); and the Board is authorized under Subsection 53A-1-401(3) to adopt rules and policies in accordance with its responsibilities.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comment has been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R280-204 continues to be necessary because it provides procedures and notice requirements for criminal background checks of designated and prospective USOR employees and volunteers. Therefore, this rule should be continued.
