RULE ANALYSIS

Purpose of the rule or reason for the change:

The Division is renumbering and changing the format of the hazardous waste rules. The change is to help the reader of the rules by providing all of the rules in one place. The new rules will follow the numbering system used by the US EPA, thus, the current hazardous waste rules must be repealed when the new rules become effective.

Summary of the rule or change:

Rule R315-12 is repealed in its entirety and is replaced by Rule R305-7.

R315-12-1. Administrative Procedures.

Administrative proceedings under the following acts are governed by Rule R305-7:

(a) Title 19, Chapter 6, Part 1 (Solid and Hazardous Waste Act);

(b) Title 19, Chapter 6, Part 6 (Lead Acid Battery Disposal);

(c) Title 19, Chapter 6, Part 7 (Used Oil Management Act);

(d) Tile 19-6, Part 8 (Waste Tire Recycling); and

(e) Title 19, Chapter 6, Part 10 (Mercury Switch Removal Act).
