NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 4-2-2(1)(h) authorizes the department to establish standards and grades for agricultural products that are distributed or sold in the State of Utah.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received by the Department since the last five-year review of the rule from interested persons supporting or opposing the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule is necessary to ensure that the consumer/buyer knows and understands the quality the fruits and vegetables being purchased. It allows for the inspection and certification of fruits and vegetables at a federally recognized standard. Therefore, this rule should be continued.
