NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 19-6-105(d) allows the Waste Management and Radiation Control Board to make rules instructing property owners to take appropriate corrective action or other response measures for releases of hazardous waste or hazardous waste constituents from the facility, including releases beyond the boundaries of the facility.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The rule has been modified once since that last five-year review and no comments were received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The rule is needed to give direction to persons that want to remove contamination for the soil at a site and to give the standards that must be met to allow specific uses of the property. Therefore, this rule should be continued.
