NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 4-3-2 authorizes the department to make rules for the enforcement of the Dairy Act. The Utah Dairy Act (Title 4, Chapter 3) requires that rules be made regarding the manufacturing, distribution, and processing of butter.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received by the department since the last five-year review of the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The rule sets out the requirements for the manufacturing of butter and similar products, such as whipped butter. The manufacturing facility must be suitable, and the process must ensure a safe product, and this can only be accomplished if facilities are under inspection by a designated regulatory facility. Therefore, this rule should be continued.
