NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Article X, Section 3, vests general control and supervision of public education in the Board; Subsection 53A-1-401(3) authorizes the Board to adopt rules in accordance with its responsibilities; Section 53A-1a-504 requires the Board to make rules regarding a charter school expansion or satellite campus; and Sections 53A-1a-505, 53A-1a-515, and 53A-1a-521 require the Board to make a rule providing a timeline for the opening of a charter school.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R277-482 continues to be necessary because it establishes procedures for timelines and approval processes for charter schools. Therefore, this rule should be continued.
