NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 62A-1-111 authorizes the Department of Human Services (DHS) to adopt rules necessary for the provision of social services and gives authority to create a code of conduct for providers. This rule clarifies the expectation of conduct for DHS employees, their employees, and volunteers who interact with DHS clients, staff, and the public.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There were no comments received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Providers shall not abuse, neglect, exploit, or maltreat clients in any way, whether through acts or omissions or by failing to deter others for acting.
