This rule provides the procedure the Department of Transportation follows to establish, designate, and operate tollways. This rule is authorized by Subsections 72-6-118(4) and 72-6-118(5), which detail the required purpose, content, and function of this rule.

The Department has not received any written comments during and since the last five-year review of the rule from interested persons supporting or opposing the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The Department has established and operates tollways. This rule needs to continue because it specifies how new tollways are established and how existing tollways are operated. The rule also sets the rates for tolls, specifies where toll revenue is to go, sets conditions under which tolls may be changed, and establishes other requirements needed to operate tollways.
