NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is enacted under the authority of Section 72-9-103 to enable the Department to enforce the Federal Motor Carrier Safety Regulations as contained in Title 49, Code of Federal Regulations (CFR), related to the operation of a motor carrier within the state, as required by Section 72-9-301.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The Department has not received any written comments during and since the last five-year review of the rule from interested persons supporting or opposing the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Section 72-9-301 still requires the Department to enforce the Federal Motor Carrier Safety Regulations as contained 49 CFR related to the operation of a motor carrier within the state. This rule incorporates those federal regulations by reference. Therefore, this rule should be continued.
