NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Title 31A, Chapter 2, authorizes the commissioner to adopt rules to implement the code. Subsection 31A-8-501(8)(c) authorizes the commissioner to identify by rule the counties with a population density of less than 100 people per square mile, independent hospitals, and federally-qualified health centers and describe how health maintenance organizations shall use the information and provide enrollees in rural areas with a notice that includes a list of non-HMO contracted medical providers they can use per certain requirements.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The department has received no written comments regarding this rule within the past five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule is needed to assure that people living in rural areas have access to adequate heath care services. Therefore, this rule should be continued.
