NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 72-3-207 requires the department to make rules necessary to administer the State Park Access Highways Improvement Program within the department and to establish the procedures for a county or municipality to apply for a grant of program money. This rule satisfies that requirement.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The Department has not received any written comments during and since the last five-year review of the rule from interested persons supporting or opposing the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Section 72-3-207 is still effective law. This rule is still needed for the Department to maintain in conformance with the requirements of that statute. Therefore, this rule should be continued.
