NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 77-27-6 gives the Board the authority to order restitution even if the court has not determined restitution. Rule R671-403 sets rules about the procedure the Board uses to order restitution.

No written comments were received related to this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule should be continued because it provides direction about how restitution may be ordered by the Board including the process and parameters for approval. The rule gives explanation and direction to victims and offenders who need to claim restitution or dispute the order of the Board.
