NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 77-27-9 and Title 63G, Chapter 3, obligates the Board to make rules under certain circumstances. In particular, the Board makes rules to implement public policy set forth by the legislature in statute.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received regarding Rule R671-101.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule provides an introduction to the Board's administrative rules and is a statement that rules should be interpreted in the interest of public safety so long as the rights of a party are not substantially impacted. Therefore, this rule should be continued.
