NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Pursuant to Subsection 53-3-221(4), the division shall make rules establishing a point system and will assign a number of points to each type of moving traffic violation as a measure of its seriousness. Pursuant to Subsection 53-3-209(2), the division shall make rules for the establishment and administration of a separate point system for persons younger than 21 years of age. Pursuant to Subsection 63G-4-203(1), if an agency enacts rules designating one or more categories of adjudicative proceedings as informal adjudicative proceedings, the agency shall, by rule, prescribe procedures for informal adjudicative proceedings.

No written public comment was received in reference to this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The division is required by Utah code to set rules and establishing a point system. Each moving traffic violation will be assigned a number of points as a measure of the seriousness of the violation. Therefore, this rule should be continued.
