NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Rule R313-21 is adopted pursuant to the provisions of Subsections 19-3-104(3) and 19-3-104(6). Subsection 19-3-104(3) states that all sources of ionizing radiation shall be registered and licensed. Subsection 19-3-104(6) allows the assessment of fees for licensing and registration.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

During the period from the previous five-year review, one modification to the rule was made. Comments received for the modification were related to the modification only, and no comments were received either expressing support or opposition to the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R313-21 establishes general licenses for the possession and use of radioactive material contained in certain items and a general license for ownership of radioactive material. The licensing is required by statute and is for the protection of citizens and of Utah and the control of radioactive material. As an Agreement State with the U.S. Nuclear Regulatory Commission (NRC), this rule is necessary in order to maintain regulatory compatibility with the NRC. Therefore, this rule should be continued.
