NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 4-2-2(1)(j) requires the department to, when necessary, make investigations; subpoena witnesses and records; conduct hearings; issue orders; and make recommendations concerning all matters related to agriculture.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received by the department since the last five-year review of the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The rule sets forth the procedures that the Animal Industry Division must follow in issuing emergency orders and citations to protect the public from unlawful agricultural and food products and services. Therefore, this rule should be continued.
