NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 77-16a-204 defines commitment and treatment of an offender with mental illness. Rule R671-207 gives guidance for the Department of Correction and the Board on transferring an offender with mental illness from the prison to the hospital or an offender whose mental health has deteriorated.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The Board supports the continuation of this rule in order to comply with the statute of committed offenders with mental illness.
