NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

The authority for the following rule is Section 63G-2-204 and Section 63A-12-104 of the Government Records Access and Management Act (GRAMA), effective 07/01/1992. Specifically, 63A-12-104(2) states: "A governmental entity that includes divisions, boards, departments, committees, commissions, or other subparts that fall within the definition of a governmental entity under this chapter, may, by rule, specify at which level the requirements specified in this chapter shall be undertaken." This rule makes it clear that all of the boards, commissions, and divisions within DHA are considered one entity and all requirements are handled by the Department administration.

No comments have been submitted.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R450-1 ensures public access to government records from the Department of Heritage and Arts in compliance with state law. Therefore, this rule should be continued.
