NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

The Public Records Management Act (PRMA), Subsection 63A-12-104(2), authorizes governmental entities to specify at which level the requirements of PRMA shall be undertaken. This provision is the basis for DEQ's rule specifying that the entire agency is the responsible entity for purposes of the sharing provisions of Section 63G-2-206. Subsection 63G-2-204(2)(d) authorizes governmental entities to make rules specifying where and to whom requests for access should be directed.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no comments on this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The primary purpose of the rule is to notify requesters where to submit GRAMA requests. A related purpose is to give the agency the full statutory period for responding to a request even for GRAMA requests that are submitted to the wrong office. Therefore, this rule should be continued.
