NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is promulgated under Section 4-5-17, which allows the department to make and adopt rules that conform to the regulations adopted under the Federal Food Drug and Cosmetic Act.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received by the department since the last five-year review of the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule adopts the Food Code which is issued by the Food and Drug Administration to protect the food supply in a retail environment. It contains the regulation on how food is to be handled and prepared. Additionally it contains the standards for cleanliness and sanitation for the facility as well as the workers. Therefore, this rule should be continued.
