NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule implements Section 65A-6-2, which authorizes the Division of Forestry, Fire, and State Lands to establish rules for the issuance of mineral leases and management of state-owned lands and mineral resources.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Division has not received any written comments with regard to this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule defines the requirements for the issuance of mineral leases and management of state-owned lands and mineral resources. The rule further outlines lease rentals and royalties, along with acreage limitations, lease provisions, the simultaneous offering process, and other provisions relating to mineral leasing management. Therefore, this rule should be continued.
