NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized under Section 63G-4-503, Subsection 26-1-5 (3), and Section 26-1-17. Utah Code allows any person to file a request for agency action requesting that the agency issue a declaratory order determining the applicability of a statute, rule, or order.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received within the Utah Department of Health, Executive Director's Office, since 04/26/2012.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule provides the procedures for the submission, review, and disposition of petitions for agency declaratory orders. Therefore, this rule should be continued.
