NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 19-5-104(1)(h) authorizes the Water Quality Board to review engineering reports, plans, specifications, and other data relating to the construction of sewerage systems and wastewater treatment works, disposal systems, and parts thereof, and to issue construction permits for their installation, modification, improvement, or upgrade. Subsection 19-5-104(1)(f) authorizes the Board to make rules that implement or effectuate the powers and duties of the Board.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule establishes minimum design requirements for wastewater collection, treatment, and disposal systems. The division director is charged to review and approve these systems. The rule is required to meet this charge. Therefore, this rule should be continued.
