NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 19-2-104 allows the Air Quality Board to promulgate rules that control, abate, and prevent air pollution from all sources. Rule R307-421 does this by ensuring that the growth of particulate matter precursor pollutants are minimized by the use of emission offsets.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
There were no comments received on this rule since the last five-year review.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R307-421 is required to minimize the growth in emissions of PM10 precursors in Salt Lake and Utah County. The rule supports the PM10 Maintenance Plan, which is incorporated by reference in Section R307-110-10. Therefore, this rule should be continued.
