NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53A-1-403.5 makes the Utah State Board of Education (Board), along with the Utah Department of Corrections, responsible for the education of inmates in custody; and Section 53A-1-401 allows the Board to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comment has been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R277-735 continues to be necessary because it specifies operation standards and procedures for inmates in corrections education programs that are the responsibility of the public school system. Therefore, this rule should be continued.
