NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 41-6a-1601(2)(c)(v) states the department shall make rules setting minimum standards covering the design, construction, condition, and operation of vehicle equipment for safely operating a motor vehicle on the highway as required under this part and that 40 CFR 82.30 through 82.42 and Part 82, Subpart B, Appendix A and B related to air conditioning equipment are adopted. Section 41-6a-1640 states that a person may not operate a motor vehicle on a highway if the motor vehicle is equipped with air conditioning equipment unless the air conditioning equipment complies with the specifications adopted under Section 41-6a-1601 and this section. Subsection 53-1-106(1)(a) states that the department shall make rules and perform the functions specified in Title 41, Chapter 6a, Traffic Code.

The agency received no comments regarding this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Subsection 41-6a-1601(2)(c)(v) states the department shall make rules setting minimum standards covering the design, construction, condition, and operation of vehicle equipment for safely operating a motor vehicle on the highway as required under this part and that 40 CFR 82.30 through 82.42 and Part 82, Subpart B, Appendix A and B related to air conditioning equipment are adopted. Subsection 53-1-106(1)(a) states that the department shall make rules and perform the functions specified in Title 41, Chapter 6a, Traffic Code. Therefore, this rule should be continued.
