This rule is authorized by Section 62A-3-104. The rule provides a clarification of the program and the federal statute that authorizes it.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Because this program is not part of the standard Older Americans Act programs and is overseen by the federal Department of Labor, this labor provides the statutory support for the Division of Aging and Adult Services to administer it. Therefore, this rule should be continued.
