NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

This rule is authorized by Section 62A-3-104. This rule lays out the standards required for Area Agencies on Aging to contract with local providers, and allows for an Area Agency to provide services directly to clients under the same standards when no other provider is available or cost effective.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments were received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The Older Americans Act specifies that services should be performed by providers in the community unless providers are not available or not cost effective. This rule clarifies that policy and provides standards for providers. Therefore, this rule should be continued.
