NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Subsection 61-1-24(1)(a) of the Utah Uniform Securities Act, which authorizes the Division to make, amend, or rescind a rule when necessary to carry out the chapter. Section 61-1-5 of the Act provides postlicensing recordkeeping requirements for licensees and also authorizes the Division to identify, through rulemaking, books and records to be maintained by licensees.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R164-5 assists licensees by identifying specific books, records, financial reports and other information that must be maintained by Division licensees. Therefore, this rule should be continued.
