NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 63G-4-202 of the Utah Administrative Procedures Act provides that an agency may by rule designate categories of adjudicative proceedings to be conducted informally. Section 63G-4-203 sets forth the procedures for such informal proceedings. Pursuant to that authority, this rule designates those categories of adjudicative proceedings which will be conducted on an informal basis.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R164-18 provides information for licensees and the public as to which actions will be conducted on an informal basis. This rule helps licensees and the public understand the procedures used in various actions taken by the Division. Therefore, this rule should be continued.
