NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 19-5-104(2) authorizes the Utah Water Quality Board to adopt and enforce rules and establish fees to cover the costs of testing for certification of operators of treatment works and sewerage systems operated by political subdivisions.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

This rule has been amended twice since the last five-year review. No written comments were received during those rulemakings. The initial changes were proposed as a result of changes in duties of the Water Quality Board's executive secretary and the division director as a result of S.B. 21 (2012). The specific language of the rule changes were developed through an advisory committee of wastewater certification stakeholders. The results of those efforts were then approved and adopted by the Water Quality Board.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is required for the Water Quality Board to implement the state's Wastewater Operator Certification Program as directed in the Water Quality Act. The certification program is established to assist in protecting the quality of waters in the state of Utah; protect the public health and the environment; provide for the health and safety of wastewater works operators; and establish standards and methods whereby wastewater works operating personnel can demonstrate competency. Therefore, this rule should be continued.
