NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Pursuant to the federal Community Services Block Grant Act, 42. U.S.C. 9901 et seq., as amended, and its accompanying regulations, 45 CFR 96.1 et seq., the Utah Legislature has passed the State Community Services Act, Section 35A-8-1001 et seq. The State Community Services Act creates the State Community Services Office and authorizes the Office to administer funds made available to the State under the above-referenced federal authorities. Section 35A-8-1004 specifically authorizes the State Office to make rules for this purpose.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received during the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule is necessary to administer Community Services Block Grant funds in accordance with state and federal law. Therefore, this rule should be continued.
