NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Authority for this rule is in Sections 72-1-201 and 72-3-102; Title 72, Chapter 4, Part 1, Transportation Code; and Sections 41-6a-302 and 41-6a-1636 of the Utah Code.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The agency has not received any written comments during and since the last five-year review of the rule from interested persons supporting or opposing the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Section 41-6a-1636 requires the Department of Transportation to make rules to permit the use of tires on a vehicle having protuberances other than rubber, if the department concludes that protuberances do not damage the highway significantly or constitute a hazard to life, health, or property is still effective. Therefore, this rule should be continued.
