NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53-3-205.6 requires the Driver License Division to establish a database of the emergency contacts of a person who holds a license or identification card. The intent of the database is to allow law enforcement to make contact with up to two emergency contacts in case of a motor vehicle accident or other emergency situation where a person that holds a license or identification card is unable to communicate with law enforcement. The information included in the database shall only be used for emergency situations as outlined in the statute and may not be used for criminal investigation purposes.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Subsection 53-3-205.6(4) authorizes the Division to make rules regarding procedures to implement the database, and specify a method for information to be added or changed in the database and additional rules required to operate the database. Therefore, this rule should be continued.
