NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 19-2-104(1)(a) gives the Air Quality Board the authority to make rules regarding the control, abatement, and prevention of air pollution from all sources. These provisions authorize this rule because Rule R307-214 incorporates by reference the federal standards for emissions of hazardous pollutants from various sources.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
There were no written comments received regarding this rule since the last five-year review.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule gives Utah the authority to enforce emission standards that would otherwise be enforced solely by the federal government. In order to retain control over hazardous air pollutants in the state, the rule should be continued.
