NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 53A-1-401 allows the Utah State Board of Education (Board) to make rules to execute the Board's duties and responsibilities under the Utah Constitution, state law, and allows the Board to withhold disbursements of state aid to any district which fails to comply with rules adopted in accordance with the law.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R277-108 continues to be necessary because it provides local school boards with a list of laws requiring local school board action and a means of assuring that local school boards are in compliance. Therefore, this rule should be continued.
